· A review of the current law in relation to the use of 'Reasonable Force', drawing reference to Section 3(1) of the Criminal Law Act 1967 in relation to making arrests, preventing crime, including the right to defend oneself and others.
· An overview of the common law in relation to an individual's right to private defence and the defence of others.
· Section 24(a) Powers of Arrest without a warrant (as amended by SOCAP Sections 1002-112)
· An overview of the inclusion of the Human Rights Act into the UK statute books, and what that means in terms of how the use of force should be managed and controlled by state authorities and servants, including the duty imposed with regard to the 'positive obligation to promote and preserve the right to life'.
· An overview of the legislation that relates to the use of physical force with children and vulnerable adults.
· A look at Health and Safety statute in respect to the duties imposed upon employers and what employers are obliged to consider in relation to the duty of care owed to staff and others with regard to the use of force by employed staff on the employer's behalf.
· The difference between criminal and civil legislation
· Identification of the risks associated with the use of physical force including instruction and guidance on positional asphyxiation and how to minimize the risk. |
