This is a book based on objective reasoning backed by research and evidential fact. As a result it challenges and dispels many of the many myths and misconceptions that exist in the physical intervention world, and as a result I am sure that it will upset some whilst empowering others.
Understand the Legalities and Liabilities of Teaching Physical Intervention and Commissioning PI Training
This book has been written to give you an insight into what physical intervention actually is and the legalities and liabilities in this area, which is a very important issue right now due to the changing legal climate that we now find ourselves in, and the implications and liabilities for trainers and organisations alike if and when something goes wrong. As such it pulls no punches but deals with the issues head on as I believe that is the only way to do so.
The following are a synopsis of the various chapters of the book which I will be initially publishing as an e-book so that you can download it. A hard copy version will follow soon after.
Chapter 1 - What is Physical Intervention? - This chapter defines exactly what physical intervention is. It draws a comparison between restrictive and least restrictive, and defines what the word 'restraint' actually means and looks at other forms of restraint may be.
Chapter 2 - The Changing Legal Climate - This chapter looks at the legal implications of using physical intervention, particularly the implications of the Corporate Manslaughter and Corporate Homicide Act 2007 and the recent amendment to the Work Related Deaths Protocol and how the potential effect these changes can have on those of you who teach physical intervention and who commission training.
Chapter 3 - The Human Rights Act - This chapter looks at the implications of Article 2 and 3 of the Human Rights Act in relation to the legal requirement imposed on all public authorities to pro-actively promote the positive obligation to preserve life and not to torture, and how those two Articles need to be balanced when providing legally defensible training, policy and guidance.
Chapter 4 - Pain Compliance Techniques - This chapter builds on the previous two chapters and covers the emotive issue of pain compliance techniques. It draws on current reference to recent reviews of the use of pain in children's services and provides a balanced and well-constructed logical approach to the use of these techniques. This is a chapter everyone should read.
Chapter 5 - Prone Restraint - The use of prone restraint is another issue that causes heated debate. In this chapter we look at the guidance issued by the House of Lords and House of Commons Joint Committee on Human Rights as well as providing a legal opinion from one of the UK's leading legal professional's Michael Mansfield QC.
Chapter 6 - BILD Accreditation - This chapter will cover BILD Accreditation. Many organisations believe that BILD's physical intervention accreditation scheme is some form of Government approved and recognised accreditation. Its not, and in this chapter we will prove this to you and show you the various correspondence that we have received from various Government Departments which prove this point. This is a very important chapter for those of you who are thinking of BILD Accreditation.
Chapter 7 - SIA Requirements - This chapter looks at the requirements of the Security Industry Authority in relation to the use of physical intervention. It covers the scope of the training provided for door supervisor licensing purposes, including our correspondence with the SIA on this point, and looks at the employers responsibility with regard to providing any additional training and what the possible consequences are of not providing any additional training.
Chapter 8 - The Rodney King Effect - This chapter deals with how we can end up behaving when having to use a system of physical intervention that doesn't work. It provides an insight into the psychological effect of dealing with a violent situation, drawing evidence from the Rodney King incident as well as other well documented and researched events. It will help many of you understand why you probably 'lost it' at some stage and hopefully provide you with some comfort in knowing why.
Chapter 9 - Politically Expedient Training - This is a personal chapter for me. It was the last time I had sat down and collaborated on an article with my close friend Peter Boatman before he died. In this chapter Peter and I discuss the issue of organisations who produce and promote legally flawed policies and managerial advice. He talks of managers becoming 'politicians' instead of 'experts' and the possible fear that drives their politically motivated agendas.
Chapter 10 - Health and Safety -
This chapter covers the various sections of the Health and Safety at Work Act that apply to physical intervention which is very important for those managers within organisations who are responsible for commissioning training. It also looks at the new inclusion of the Health & Safety Offences Act 2008 and the relationship between the Corporate Manslaughter and Corporate Homicide Act 2007 as well as the relationship between physical intervention and manual handling, whilst addressing such issues as someone restraining on their own and refresher training.
Chapter 11 - The Characteristics of Skill Performance - This chapter looks into the aspect of how a 'skill' is defined and how to balance the ability of staff with the organisations expectations of what they require them to do. It looks at the aspect of 'ability' and the differences between men and women as well as the differences between different motor skill classifications, illustrating why some 'off the shelf - one size fits all' packages will fail if these aspects are not taken into consideration.
Chapter 12 - Why Human Errors Really Occur
- This chapter looks at the structure of human failure from a structured accident investigation model. It illustrates the fact that most errors that are attributable to human failure, resulting in an individual being 'blamed' are not the fault of the person who was directly involved at all, but are failures normally hidden within the organisational management system. This chapter is a must for any health and safety professional, expert witness, professional trainer or lawyer to know and understand.
